User Agreement

1. Introduction

Heartroot is operated as a sole trader in Australia and is a personal memory-keeping application designed to help caregivers gently capture, organise, and revisit moments from pregnancy through childhood. Heartroot provides a timeline, gallery, journaling prompts, moonbow highlights, and a starfield of memories to support emotional connection and reflection. By creating an account or using Heartroot, you agree to these Terms & Conditions (“Terms”). These Terms govern your access to and use of Heartroot, including all content, features, and services provided within the app.

Key definitions:

  • “User” means the person creating and managing an account.
  • “Content” means memories, photos, journal entries, milestones, tags, and any other material you upload.
  • “Stages” refer to the life phases within Heartroot (Pregnancy, Newborn, Infant, Toddler, Child, and other custom stages you create).
  • “Moonbow Highlights” are special memories marked for display in the Moonbow constellation view.
  • “Starfield” is the premium night-sky view where memories appear as glowing stars you can explore.

2. Eligibility

You must be at least 16 years old to create a Heartroot account. If you are capturing memories about a child, you confirm that you are the parent or legal guardian of that child or have permission to record and store their information. Heartroot is intended for personal use. If you are using Heartroot on behalf of another person, you must ensure they understand and agree to these Terms.

3. User Accounts

To use Heartroot, you may need to create an account. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. Heartroot may offer optional privacy features such as PIN-locking or private mode. You are responsible for enabling these features if desired. You may delete your account at any time. Upon deletion, your data may be permanently removed from Heartroot’s systems.

4. User Content

You retain full ownership of all Content you upload to Heartroot. By using the app, you grant Heartroot permission to store, process, and display your Content solely for the purpose of providing app functionality.

You agree not to upload:

  • Illegal content
  • Abusive or harmful material
  • Content that violates the rights of others
  • Content containing sensitive information about individuals without their consent

Heartroot does not claim ownership of your memories, photos, or audio clips.

5. Data Storage & Privacy

Heartroot stores data using Lovable Cloud (backend database, authentication, and file storage) and Stripe for payment processing. Your Content may be backed up, cached, or processed to ensure smooth app performance. Heartroot may collect:

  • Account information (email address, optional display name)
  • Child information (name, birth date, and related memories)
  • Uploaded Content (entries, photos, captions, tags, highlights)
  • Usage and device data (for performance, security, and troubleshooting)
  • Notification preferences

Heartroot does not sell your data.

A separate Privacy Policy explains how data is collected, used, and protected.

6. Children’s Data

Heartroot allows you to store memories about children. You confirm that you have the legal right to store this information. Heartroot does not create accounts for minors.

Heartroot takes reasonable measures to protect children’s data but cannot guarantee absolute security.

7. Acceptable Use

You agree not to:

  • Misuse or disrupt the app
  • Attempt to reverse engineer Heartroot
  • Scrape or extract data
  • Upload harmful or illegal content
  • Interfere with other users’ experience
  • Use Heartroot for commercial or malicious purposes

8. Intellectual Property

Heartroot’s branding, illustrations, moonbow and starfield design, memory tree motif, leaf-sprout icons, UI components, and all other visual or functional assets are owned by Heartroot. You may not copy, modify, distribute, or create derivative works from Heartroot’s assets without permission. Your Content remains yours.

9. App Features & Limitations

Heartroot aims to provide a stable, nurturing experience, but you acknowledge that:

  • Features may change over time
  • Some features may be in beta
  • Service interruptions may occur
  • Data loss may occur despite reasonable precautions
  • Third-party integrations may be added or removed
  • Heartroot is provided as is without guarantees.

10. Subscriptions & Payments

Heartroot offers a Premium subscription that unlocks additional features. By subscribing, you agree to the following:

  • Premium plans: A$4.99 per month or A$49.99 per year, billed in Australian dollars (AUD). Prices include applicable tax where collected by our payment processor.
  • Billing: Subscriptions are billed automatically through Stripe on a recurring monthly or yearly basis. You authorise Stripe to charge the payment method associated with your account.
  • Cancellation: You may cancel your subscription at any time from Settings → Billing or through the Stripe customer portal. Cancellation takes effect at the end of your current billing period; you will continue to have Premium access until that date.
  • Refunds: Heartroot does not offer refunds for partial billing periods. If you believe a charge was made in error, please contact us.
  • Free tier: Non-premium users may add up to four children and choose from two colour schemes. Premium subscribers may add more children and access all colour schemes and the Starfield.
  • Price changes: We may change subscription prices. Any price change will take effect at the start of your next billing period after notice is provided.

11. Termination

Heartroot may suspend or terminate accounts that violate these Terms or engage in harmful behaviour.

Upon termination:

  • You may lose access to your Content.
  • Heartroot may delete your data.
  • You may not be able to create a new account immediately.
  • You may terminate your account at any time.

12. Liability & Disclaimers

Heartroot is not responsible for:

  • Loss of Content
  • Emotional outcomes from using the app
  • Decisions made based on app prompts or features
  • Third-party service failures
  • Unauthorized access due to your negligence

Heartroot does not provide medical, psychological, or therapeutic advice.

13. Changes to Terms

Heartroot may update these Terms at any time. When changes occur:

  • A new version number will be published
  • You may be asked to re-accept the Terms
  • Continued use of the app indicates acceptance
  • Versioning ensures clarity and compliance.

14. Email Communications & Consent

By creating a Heartroot account, you consent to receive emails from us at the address you provide. These include:

  • Service emails — sign-in codes, account and security notices, subscription and payment confirmations, deletion requests, and replies to your support messages. These are necessary to operate your account and cannot be opted out of while your account remains active.
  • Optional emails — daily journaling reminders, gentle prompts, booklet-ready notices, and occasional product updates. You may turn these off at any time in Settings, or by using the unsubscribe link included in the email.

Emails are sent through our email delivery provider (Resend) from no-reply@heartrootjournal.com. We do not sell, rent, or share your email address for third-party marketing. Withdrawing consent to optional emails does not affect your access to Heartroot. If you would like your email address removed entirely, you can delete your account or contact us.

15. Cookies, Local Storage & Device Data

Heartroot uses cookies and local storage technologies to keep the app working smoothly and securely when you visit from a browser. These small files are stored on your device and help us provide the experience you expect.

What we use them for:

  • Authentication — to keep you signed in safely between visits and to verify your session with our backend.
  • Preferences — to remember your chosen theme colour, notification settings, and app display choices.
  • Offline access — to temporarily cache your memories and photos so you can keep browsing when your connection drops.
  • App shell — to support installation as a web app on your home screen and to load quickly on repeat visits.
  • Performance — to help us understand how the app is used so we can improve reliability and fix issues.

Heartroot does not use cookies for third-party advertising or tracking. You can manage, block, or clear cookies and local storage through your browser or device settings at any time. Please note that doing so may sign you out or reduce offline functionality until you reconnect and the app refreshes.

If you install Heartroot as an app on your device, the operating system may also store app data such as cached images and login tokens. This data is removed when you delete the app or clear the app data from your device settings.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of Heartroot shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

Heartroot is operated by a sole trader based in Australia. If you access Heartroot from outside Australia, you do so on your own initiative and are responsible for compliance with the laws of your local jurisdiction.
